The Position of Digital Assets as Inheritance Objects in the Indonesian Legal System and the Reconstruction of Their Transfer Mechanism to Heirs

The development of digital technology has given rise to various forms of digital assets with economic value, but they have not yet been fully accommodated within the Indonesian inheritance law system. This research aims to analyze the position of digital assets as inheritance objects and to reconstruct the mechanism for their transfer to heirs. The research uses a normative juridical method with a legislative and conceptual approach through the examination of primary and secondary legal materials. The research results show that digital assets with economic value and transferable rights can, in principle, be part of the estate, but they need to be distinguished from personal data and access means. Reconstruction of the transfer mechanism includes inventorying, proof of ownership, verification of heirs, asset classification, access verification, and transfer. This research implies the need for an inheritance law update that is adaptive to the developments in digital technology.
